Conditions of use, delivery and payment of Lorenzo Martelli. Lorenzo Martelli is subsidairy of Dutch Ties. Dutch Ties is registered at the Chamber of Commerce number 24395604.
Article 1. Definitions
1.Lorenzo Martelli is an enterprise offering luxury accesories for men. All accesories can be bought online at www.lorenzomartelli.com. Lorenzo Martelli also designs and produces custom made neckties for companies.
1.2 These conditions of use (further: conditions), belonging to all online activities of Lorenzo Martelli, are in accordance with the Algemene Voorwaarden Thuiswinkel and the Gedragsregels Thuiswinkelwaarborg of the Dutch Thuiswinkel Organisation. These conditions and rules of conduct can be found on the webstie www.thuiswinkelwaarborg.nl.
Article 2. Relevance
2.1 On all offers, orders and agreements using the websites of Lorenzo Martelli these Conditions of use apply.
2.2 By accepting an offer or making an order you will agree to the Conditions of use..
2.3 A difference to the Conditions can be made by letter. All other articles will still be applicable.
2.4 Al rights and claims, as in these Conditions and all other agreements in name of Lorenzo Martelli, are also applicable to hired intermediaries and third parties.
Article 3. Agreements
3.1 An agreement is final after the acceptation of the order of a customer by Lorenzo Martelli. Lorenzo Martelli has the right to refuse an order or ask additional information. If an order will not be accepted will a reason be given to the customer.
3.2 If restitution based on the Conditions of use of Lorenzo Martelli is given will this restitution be given within 10 workingdays. Lorenzo Martelli is not responsible if this the restitution takes longer due to circumstantes beyond her control and/or mistakes by third paries (banks or creditcard companies).
Article 4. Prices
4.1 All prices are euros or dollars, including tax. Handling- and shipping are free (unless stated otherwise).
4.2 Handling- and shippingcosts are free. .
4.3 Lorenzo Martelli can not be held responsible for prices which are cleary wrong. There can not be any claim due to wrong price information.
Article 5. Payment
5.1 Payment can be made as stated in the checkout process. Lorenzo Martelli has the right to ask for additional payment conditions. Client will recieve an invoice right after placing his order. This order includes the total order amount including shipping and handling. Payment will be mad upfront by Paypal or banktransfer. Lorenzo Martelli can decide to transfer the items before payment (based on an invoice). Possible payment methodes are:
a) Banktransfer to the bankaccount stated on your invoice.
b) Direct and online by Paypal (creditcard also). Your payment will be autorised online. No additional costs for Paypal payments are charged.
5.2 Client gives Lorenzo Martelli permission to perform all actions to finish the payment chosen by the client.
5.3 If banktransfer is chosen date of payment is the date the payment is credited to the bankaccount of Lorenzo Martelli
Article 6. Delivery
6.1 Lorenzo Martelli aspires to ship all orders withing 3 workingdays after receiving the payment. Lorenzo Martelli is not obligated to meet this term.
6.2 The utmost term is 10 days after payment. If the delay is not the fault of Lorenzo Martell this term is not applicable. This term is also not applicable if stated otherwise in the product information.
6.3 If delivery delays due to low stock the order can be canceled. Lorenzo Martelli will inform the client within 7 workingdays. Client has the right to cancel his order. Lorenzo Martelli will refund the client within 10 workingdays.
6.4 Deviations in colour-, design- en/or price are possible.
Article 7. Ownership
Ownership of all delivered goods will transfer from Lorenzo Martelli to the client when all obligations of the customer to Lorenzo Martelli has been fulfilled.
Article 8. Returning purchased goods
Lorenzo Martelli strives to inform you as good as possible about all items. If an items is still not of you liking, you can return the goods to Lorenzo Martelli.
All costs for returning are for the client. Als the conditions below has to be followed:
8.1 Articles, purchased through wwww.lorenzomartelli.com can be returned without giving a reason. Returning is possible within 7 days after the client has received the goods. Following demands has to be met:
* Shipping and handling for returning are at cost and risk of the client
* A shipment without or not enough shipping costs paid will not be accepted.
* Goods returned can not be worn or damaged and must be returned in the original packaging.
8.2 Lorenzo Martelli only accepts returned goods which meet above requirements.
Article 9. Orders/communcation
For misunderstanding, delays or partly received orders and announcements due to using the Internet in communication between Lorenzo Martelli and Client, or between Lorenzo Martelli and a third party, Lorenzo Martelli is not responsible. Lorenzo Martelli will be responsible if Lorenzo Martelli is guily of serious misconduct or gross negligence
Article 10. Guarantee
10.1 Lorenzo Martelli guarantees the similarity of the goods to the order and the product specifications.
10.2 The duration of guarantee is six months. This guarantee does not apply when flaw is due to 1. wrong usage, 2. damaging 3. theft 4. neglect 5. normal wearing out.
10.3 Guarantee will be declined if other than assigned by Lorenzo Martelli has tried to repair the goods.
10.4 Guarantee means Lorenzo Martelli will 1. bear the costs for repair, 2. will replace the goods for a similar item, and if this is not possible 3. refund the order amount.
Article 11. Force majeur
Lorenzo Martelli has in case of circustances beyond her control, the right, at own choice, to put the order of a client on hold or to cancel the order. Lorenzo Martelli will notify the customer when an order is put on hold or cancelled. No compensation will have to be paid by Lorenzo Martelli.
Article 12. Dutch law and legal court
12.1 Dutch law applies to all rights, obligations, offers, orders and agreements.
12.2 All conficts will be settled in Dutch legal court.
